RFE与NOID的区别

Request for Evidence通常表示审理者认为还需要特定证据才能判断资格;Notice of Intent to Deny通常表明现有记录已形成拟拒绝方向,但在决定前给予回应机会。名称不同,案件姿态和回应重点也不同。

第一件事不是立刻找材料

先逐段拆解通知:适用的法律标准是什么;政府承认了哪些事实;认为哪一项未满足;是否引用了外部或不利信息;截止日期如何计算。若没有建立问题表,就容易提交大量无关文件,却没有回答核心质疑。

证据与论证要配对

回应通常需要同时处理事实和法律。新文件应说明来源、证明目的及与问题的关系;申请信则解释证据为何满足标准。重复原申请、堆叠推荐信或仅表达不同意,通常不能替代针对通知内容的实质回应。

不能修改过去事实来迎合问题

若原材料有日期、职位或描述错误,应准确说明并提供依据,而不是悄悄提交另一版本。重大不一致可能影响可信度。涉及虚假陈述、材料真实性或政府掌握的不利信息时,应尽早由律师评估风险和回应范围。

截止日期必须严肃管理

通知会说明回应期限和提交方式。应为取证、翻译、专家分析及内部复核预留时间,并保存完整递交记录。不要假设一定能延期,也不要在最后一天才发现文件寄送、线上上传或页数限制问题。

也可能没有RFE机会

申请人不应把RFE当作政府保证提供的“第二轮材料清单”。在某些情况下,案件可能在没有先发RFE或NOID的情况下被拒。因此,初次递交就应尽可能满足证明责任,而不是故意保留关键材料等待补件。

回应后如何管理案件

保存通知、完整回应、附件索引、寄送或上传凭证以及政府签收信息。若后来收到决定,先确认审理者是否考虑了已提交的关键材料。完整档案也方便在需要重新申请、动议或上诉时准确复盘。

Note for applicants based in China

Applicants based in China usually also need to handle three things: keeping Chinese- and English-language documents consistent, making sure funds and income can be explained with independent documentation, and managing the gap between priority-date timing and a child's age. Any packaging that doesn't match the underlying facts creates greater risk at the RFE or interview stage.
