Pathways overview

See the pathway clearly before you file

A single family often qualifies for more than one pathway — or for none yet. This page compares the five main routes on the same dimensions: requirements, timing, capital, failure modes, and cost structure.

These comparison dimensions include no success-rate or timing promises. Visa Bulletin dates and processing times change with policy — always confirm against the latest USCIS / DOS publication.

Three core service lines

Our core business: EB-5, corporate immigration, employer-sponsored

Each of these three has a full service page covering process, requirements, evidence, deliverables, fee structure and stop conditions.

EB-5 Investor Green Card

Flagship program

Invest compliant capital in a verifiable commercial project, meet the job-creation requirement, and pursue permanent residence for the whole family.

Fits

  • · Families who want a route that does not depend on an employer, a degree, or a professional achievement record
  • · High-net-worth families with a clean, fully documentable source of funds
  • · Applicants whose primary goal is their children's education and the family's long-term plans

Risk

  • · A broken or unexplainable chain of source-of-funds evidence
  • · Job-creation projections that are too thin, with no employment cushion
  • · Commercial failure of the project causing loss of principal (a separate issue from immigration approval)

L-1A / EB-1C Corporate Immigration

Core differentiator

Build a genuine U.S. business — through formation or acquisition — and use a manager/executive path to plan employment-based permanent residence.

Fits

  • · Business owners and shareholders who already operate a real company in China
  • · Managers or executives whose duties can be demonstrated through an organizational chart
  • · Families willing to genuinely operate a U.S. business and take on real operating responsibility

Risk

  • · The U.S. entity lacks real business, revenue, staff, or an operating record
  • · The role is essentially hands-on execution rather than management, unsupported by the org chart
  • · The business is packaged as a shell company or a "managed-on-your-behalf" arrangement, which rarely survives scrutiny

EB-2 / EB-3 / EW-3 Employer-Sponsored Immigration

Scalable core line

A verified U.S. employer offers a genuine, long-term position and supports an employment-based immigration process where lawful and applicable.

Fits

  • · Professionals with a qualifying degree or professional credential (EB-2 / EB-3 professionals)
  • · Skilled workers with two or more years of training or experience (EB-3 skilled workers)
  • · Applicants for long-term, non-skilled positions (EW-3 other workers)

Risk

  • · The employer's business deteriorates, the petition is withdrawn, or the position disappears
  • · The job description does not match the actual duties performed
  • · "Buying a job in exchange for a green card" arrangements, which are a serious compliance risk

Other routes we can assess

EB-1A, NIW and family-based routes, handled in full

Offered as complementary routes, with requirements, timing, failure modes and cost structure summarized on each page.

EB-1A Extraordinary Ability

Mainstream self-petition

A self-petition route built on sustained national or international acclaim, with no employer sponsor required.

Fits

  • · Applicants with a verifiable record of achievement and influence in their field
  • · Applicants with documentable awards, original contributions, judging experience, or media coverage

Risk

  • · Meeting three criteria on paper but failing the final merits determination because the overall record is too thin
  • · Piling up evidence without an argument for actual influence or impact
  • · Recommendation letters that read the same and lack independent third-party support

NIW National Interest Waiver

Mainstream self-petition

Built around an endeavor of substantial merit and national importance, this route waives the labor certification and employer sponsorship requirement.

Fits

  • · Researchers, engineers, and university-affiliated scientists
  • · Entrepreneurs with a clear technical or industry-advancing plan
  • · Advanced-degree or exceptional-ability applicants with a clearly articulated endeavor

Risk

  • · The proposed endeavor is vague and lacks an execution plan or supporting resources
  • · Treating personal achievement as equivalent to national interest
  • · Insufficient positioning to advance the endeavor: no funding, no collaborators, no track record

Family-Based Immigration

Full-service support

An immigration category built on family relationships, with clear rules but wait times and age risks that require early planning.

Fits

  • · Spouses, children, and parents of U.S. citizens or permanent residents
  • · Siblings of U.S. citizens (a preference category with a long wait)
  • · Families who already have a qualifying relationship and want to reunite long term

Risk

  • · Weak proof of relationship or conflicting historical records
  • · The financial sponsor's income is insufficient and no qualifying joint sponsor is available
  • · A child ages out, changing the category or requiring the family to re-queue

Book a structured initial consultation

We start with your family structure, timing requirements and available resources, tell you which parts are workable and which are not, and then recommend a next step. An initial consultation does not create an attorney-client relationship and is not legal advice.
