什么是同步递交
当职业移民签证名额按适用规则可用时,申请人可能在提交I-140的同时递交I-485,或在I-140待审期间追加I-485。是否可以递交,需要核对类别、出生地、优先日、国务院公告和USCIS当月指定图表。
I-140与I-485审查不同
I-140主要处理职业移民分类资格,例如杰出程度、国家利益豁免或雇主职位资格;I-485处理申请人能否在美国调整为永久居民,包括签证可用性、入境与可入境性。I-140获批不会自动让I-485获批。
EAD解决工作许可
基于待审I-485申请的EAD,可以在其有效范围内提供工作授权。它不是永久居民身份证明,也不必然延长此前的非移民身份。是否使用EAD、是否继续维持原身份,应结合主申请风险、家属情况和未来计划分析。
AP解决特定旅行问题
Advance Parole通常用于在I-485待审期间寻求获准旅行并返回,但它不是签证,也不保证入境。未经适当文件离境可能影响I-485;某些持特定身份者可能适用不同规则。出行前应核对文件有效期和个人记录。
副申请人需要单独管理
配偶和子女通常各自提交相应表格、体检及附随申请,并分别收到通知。主申请获批不代表家属文件自动完整。孩子年龄、婚姻状态、指纹、旅行和工作许可都应单独跟踪。
同步递交的权衡
优点可能包括更早进入调整程序和申请工作旅行文件;代价是若基础申请被拒,附随申请可能失去基础,并产生费用和身份规划风险。同步递交应建立在独立资格评估上,而不是把I-485当作I-140的保险。
收据与有效期分别核对
一套同步递交会产生多份收据和决定,每位家庭成员的号码也不同。应建立清单记录指纹、体检、EAD、AP和I-485状态,并在使用任何文件前查看持有人、类别和有效期,不能凭“全家一起递交”推定同步有效。
Note for applicants based in China
Applicants based in China usually also need to handle three things: keeping Chinese- and English-language documents consistent, making sure funds and income can be explained with independent documentation, and managing the gap between priority-date timing and a child's age. Any packaging that doesn't match the underlying facts creates greater risk at the RFE or interview stage.
