排期通常看出生地
很多申请人误以为持有哪国护照,就查看哪国排期。实际上,配额归属通常以出生地为基础,并存在法定例外。因此,后来入籍其他国家、长期居住海外或持有第二本护照,通常不会自动改变出生地配额。
夫妻之间可能如何适用
当夫妻作为同一移民案件的主申请人与衍生配偶一同移民时,在满足规定条件下,可能使用配偶的出生地进行配额归属。这通常被称为交叉配额。其价值在于避免一方受较长的出生地排期限制。
不是“借一个出生地”那么简单
需要确认双方确实具有合格婚姻关系、配偶能够作为衍生受益人、两人移民程序如何衔接,以及申请和签证名额是否按规则一同处理。若配偶自行拥有独立案件,或家庭成员不同时移民,分析可能更复杂。
子女与父母也有特殊规则
除夫妻外,法律对某些儿童出生地与父母出生地的归属也可能提供规则,但不能把夫妻原则直接推广到所有亲属。每名家庭成员都应核验出生地、主从关系和案件类别。
文件一致性很重要
出生证明、护照、户籍或历史申请中若出现出生地点写法不一致,应先确认事实和标准英文表达。交叉配额不是隐藏出生地,而是在完整披露后依法适用相应配额规则。
规划时不要只看当前排期
交叉配额可能显著影响时间线,但签证公告会变化,婚姻与衍生资格也需持续满足。应将其与CSPA、领事或境内程序、主申请人类别及家庭同行安排一起分析。
何时最值得核验
夫妻出生地不同、主申请人所在类别对某一出生地有明显排期,或孩子接近超龄时,都值得尽早核验。若案件已经进入NVC或I-485阶段,还应确认此前表格是否正确反映了出生地和衍生关系。
出生地规则属于配额分析,不会替代对主申请资格和可入境性的审查。使用何种配额,应在递交前形成有文件支持的结论。
Note for applicants based in China
Applicants based in China usually also need to handle three things: keeping Chinese- and English-language documents consistent, making sure funds and income can be explained with independent documentation, and managing the gap between priority-date timing and a child's age. Any packaging that doesn't match the underlying facts creates greater risk at the RFE or interview stage.
