符合条件时,主申请人的配偶和未婚未满21岁的子女可以作为衍生申请人随同办理。但“可以随行”不等于所有家庭都能按同一节奏安全推进。孩子年龄、出生地、婚姻状态、家庭成员所在国家以及未来学习安排,都会影响主申请人和程序选择。

谁做主申请人不能只看谁出资

出资人、资金赠与人和移民申请主申请人可以涉及不同角色,具体安排取决于资金来源证明和法律结构。选择夫妻中的哪一方作为主申请人,还应比较职业履历、身份历史、出入境安排以及潜在不可入境问题。仅因为资产登记在某一方名下就仓促决定,可能留下不必要的解释成本。

子女临近21岁时需要单独测算

美国移民法对“儿童”的年龄有专门规则,CSPA可能在特定条件下提供保护,但并非简单的“递交即永久锁龄”。签证可用性、申请待审时间以及后续是否及时采取行动,都可能影响计算。只要家庭中有接近21岁的子女,就应在项目筛选前进行独立年龄分析。

家庭变化必须及时进入方案

申请期间结婚、离婚、新生子女、主申请人死亡或家庭成员决定分批赴美,都可能改变文件和程序。家人不一定必须同一天完成领事程序或调整身份,但分批办理涉及资格延续、通知和时间要求,不能只凭经验判断。

身份结果与投资安排要分开看

家庭成员的移民资格依附于主申请人的EB-5基础,但投资权益、继承安排和本金返还对象取决于认购文件、企业文件及适用法律。尤其是夫妻财产、赠与和继承结构较复杂的家庭,应提前让移民律师、投资顾问和税务专业人士分别审查。

先做家庭时间轴,再选项目

一个合适的EB-5方案,应当把每位家庭成员的年龄、所在地、现有身份和未来三至五年计划放在同一张时间轴上。项目本身再优质,也无法自动解决子女超龄或程序选择错误。

Applicants based in China usually also need to handle three things: keeping Chinese- and English-language documents consistent, making sure funds and income can be explained with independent documentation, and managing the gap between priority-date timing and a child's age. Any packaging that doesn't match the underlying facts creates greater risk at the RFE or interview stage.
