EB-5不是递交一张表后等待结果

一个完整EB-5周期通常同时包含投资交易与移民程序。项目认购、资金入账、I-526或I-526E申请、签证或境内调整、取得有条件永久居民身份、I-829解除条件以及商业退出,各自有不同文件、判断主体和风险点。

区域中心投资人通常从I-526E开始

区域中心先就具体投资项目提交I-956F后,符合条件的投资人才能按规则提交I-526E。I-956F已经提交或项目收到相关回执,不等于投资人的申请自动获批,也不等于项目获得政府投资背书。直投投资人的申请表格和证据结构有所不同。

获批后还要取得移民签证或调整身份

人在美国且符合条件者可能考虑I-485调整身份;人在境外通常经过NVC和领事程序。是否能够同步递交、何时有签证名额以及申请期间如何维持身份,应结合当期签证公告和个人记录判断。

两年条件期从成为居民开始计算

EB-5投资人及随行家庭最初通常获得有条件永久居民身份。条件期内需要继续关注投资维持、项目执行和就业创造证据,而不能在取得绿卡后立即把项目文件搁置。项目方的定期报告质量会直接影响后续准备。

I-829审查的是解除条件资格

投资人应在适用申报窗口提交I-829,说明投资及就业要求的满足情况。此时需要的证据很大一部分产生于此前数年,因此项目运营、资金使用和就业材料必须持续保存。等待I-829期间的身份与证明文件问题也应依官方规则处理。

商业退出是另一条时间线

解除条件、贷款到期和本金返还并非同一事件。正式协议中的期限、延期、再部署与分配机制,必须在投资前理解。TIHU将各阶段分开展示,以免把“申请进度”误当成“项目退出进度”。

Note for applicants based in China

Applicants based in China usually also need to handle three things: keeping Chinese- and English-language documents consistent, making sure funds and income can be explained with independent documentation, and managing the gap between priority-date timing and a child's age. Any packaging that doesn't match the underlying facts creates greater risk at the RFE or interview stage.
