第一组问题:你到底与谁签约

中国移民服务公司、美国雇主、美国律师和其他供应商是不同角色。合同应写明各主体名称、服务范围、收款项目和联系机制。服务公司协调资源,不等于它可以代替雇主作出招聘决定或代替律师提供美国法律意见。

第二组问题:岗位目前处于什么状态

应明确岗位名称、地点、基本职责、最低要求、预计工资条件、全职与永久性质,以及目前处于雇主核验、现行工资、招聘、PERM还是后续阶段。尚未确定的内容应标注为待确认,而不是先写成保证。

第三组问题:费用支付给谁

合同应拆分服务费、律师费、翻译或评估费、政府费及其他第三方费用,说明付款节点和收款主体。还要询问服务机构是否同时从雇主或其他主体收取报酬,避免把岗位本身变成没有解释的收费项目。

第四组问题:失败和变化如何处理

雇主撤回、岗位取消、公司出售、PERM审计或拒绝、I-140拒绝、排期过长、申请人资历不符,各自应有不同处理机制。所谓“不成功退款”必须列明成功的定义、不可退费用、扣除条件和退款时间。

第五组问题:谁控制文件与信息

申请人应知道谁保管已提交材料、是否能够取得副本、重大通知由谁传达,以及个人资料如何处理。雇主的保密信息可以合理限制,但不能让客户完全无法了解自己的案件节点。

第六组问题:承诺是否超过任何人的权限

服务机构不能保证DOL、USCIS或领馆结果,雇主也不应被说成“发放绿卡”。TIHU主张把可提供的服务、依赖第三方的事项和政府裁量分别写清;一份克制的合同,比一份充满保证却无法执行的合同更有价值。

Note for applicants based in China

Applicants based in China usually also need to handle three things: keeping Chinese- and English-language documents consistent, making sure funds and income can be explained with independent documentation, and managing the gap between priority-date timing and a child's age. Any packaging that doesn't match the underlying facts creates greater risk at the RFE or interview stage.
