移民服务合同怎么看:签字前必须找到的八个答案

合同不是“项目介绍”的附件,而是发生延期、拒绝、撤回或争议时唯一可执行的责任地图。先找主体,再看交付、费用和退出。

1. 谁与谁签约

先核对合同首页与签字页:公司的完整法定名称、注册地、地址和签字人是否一致。品牌、中文简称和顾问个人不能替代法定主体。如果一项方案涉及中国服务公司、美国律师、项目方或雇主,通常应分别说明各自合同关系,不能用一份模糊的“全包协议”掩盖责任。

2. 买到的到底是什么

服务范围要能转化为清单:初步评估、材料整理、翻译协调、法律文件、项目尽调材料、公司运营支持、雇主核验、面试准备,分别由谁完成。警惕“协助办理全部手续”“提供全程服务”等无法验收的语言,也不要把移民服务误写成购买批准结果。

3. 哪些内容明确不包含

好合同会列出边界。例如政府费、翻译、公证、体检、第三方专业报告、诉讼、上诉、RFE答复或后续I-829是否另收费。没有写明的“口头赠送”很难在争议时证明。客户也应确认普通咨询是否包含对复杂税务、证券或公司法问题的专业意见。

4. 付款节点与交付节点是否对应

费用最好对应可识别的阶段,而不是签约当天支付全部款项后只等待结果。应写清币种、税费、收款账户、发票或收据、第三方费用和逾期规则。若收款主体与交付主体不同,合同必须解释代收依据以及退款由谁负责。

5. 退款条款要按情形拆开

“不过退款”必须追问退哪些钱、什么算“不通过”、何时申请、扣除哪些成本。客户主动终止、材料不实、政策变化、律师认为不宜继续、雇主撤回、项目取消、政府拒绝,后果可能完全不同。退款条件不应只藏在附件或销售聊天中。

6. 变化和失败由谁处理

合同应规定沟通频率、材料保管、重大变化通知、替换人员、终止服务和档案返还。对于周期较长的项目,还应说明雇主或项目变化时的选择、时限和额外费用。任何机构都无法保证政府批准、排期或投资回报;真正重要的是变化发生后有无程序。

7. 签约前形成一页摘要

把合同压缩为八个答案:主体、角色、交付、期限、费用、退款、退出、争议。要求销售承诺写入合同或正式附件,并保留最终签署版和付款凭证。若中英文版本并存,还要确认冲突时以哪一版为准。

Applicants based in China usually also need to handle three things: keeping Chinese- and English-language documents consistent, making sure funds and income can be explained with independent documentation, and managing the gap between priority-date timing and a child's age. Any packaging that doesn't match the underlying facts creates greater risk at the RFE or interview stage.
